COMISIA EUROPEANĂ,
având în vedere Tratatul privind funcţionarea Uniunii Europene,
având în vedere Regulamentul (UE) 2016/429 al Parlamentului European şi al Consiliului din 9 martie 2016 privind bolile transmisibile ale animalelor şi de modificare şi de abrogare a anumitor acte din domeniul sănătăţii animalelor ("Legea privind sănătatea animală") (1), în special articolul 259 alineatul (1) litera (c),

Întrucât:
(1)Gripa aviară înalt patogenă (HPAI) este o boală infecţioasă virală a păsărilor care poate avea un impact mare asupra profitabilităţii aviculturii, cauzând perturbări ale comerţului în Uniune şi ale exporturilor în ţări terţe. Virusurile HPAI pot infecta păsări migratoare, care ulterior pot să le răspândească pe distanţe lungi în timpul migraţiilor lor de toamnă şi de primăvară. Prin urmare, prezenţa virusurilor HPAI la păsări sălbatice reprezintă o ameninţare continuă de introducere directă şi indirectă a acestor virusuri în exploataţiile de păsări de curte sau de păsări captive. În cazul apariţiei unui focar epidemic de HPAI, există riscul ca agentul patogen să se răspândească la alte exploataţii de păsări de curte sau de păsări captive.
(2)Regulamentul (UE) 2016/429 stabileşte un cadru legislativ pentru prevenirea şi controlul bolilor care sunt transmisibile la animale sau la om. HPAI se încadrează în definiţia unei boli listate din regulamentul respectiv şi face obiectul normelor de prevenire şi control al bolilor prevăzute în acesta. În plus, Regulamentul delegat (UE) 2020/687 al Comisiei (2) completează Regulamentul (UE) 2016/429 în ceea ce priveşte normele de prevenire şi control al anumitor boli listate, inclusiv al HPAI. În particular, articolul 21 din regulamentul delegat respectiv prevede că, în cazul apariţiei unui focar de boală de categoria A într-o unitate, autoritatea competentă trebuie să instituie imediat o zonă de restricţii, care cuprinde o zonă de protecţie, o zonă de supraveghere şi, dacă este necesar, zone suplimentare de restricţii în jurul sau adiacent zonelor de protecţie şi de supraveghere.
(2)Regulamentul delegat (UE) 2020/687 al Comisiei din 17 decembrie 2019 de completare a Regulamentului (UE) 2016/429 al Parlamentului European şi al Consiliului în ceea ce priveşte normele de prevenire şi control al anumitor boli listate (JO L 174, 3.6.2020, p. 64, ELI: http://data.europa.eu/eli/reg_del/2020/687/oj).
(3)Decizia de punere în aplicare (UE) 2023/2447 (3) a Comisiei a fost adoptată pe baza Regulamentului (UE) 2016/429 şi stabileşte măsuri de urgenţă la nivelul Uniunii vizând focarele de HPAI.

(4)În particular, articolul 2 litera (a), articolul 3 litera (a) şi, respectiv, articolul 4 litera (a) din Decizia de punere în aplicare (UE) 2023/2447 prevăd că, în urma apariţiei unor focare de HPAI, zonele de protecţie, zonele de supraveghere şi zonele suplimentare de restricţii care trebuie să fie stabilite în conformitate cu Regulamentul delegat (UE) 2020/687 de autorităţile competente ale statelor membre menţionate în anexa la decizie trebuie să cuprindă cel puţin arealele menţionate ca zone de protecţie, zone de supraveghere şi zone suplimentare de restricţii în anexa respectivă. Articolul 2 litera (b), articolul 3 litera (b) şi articolul 4 litera (b) din Decizia de punere în aplicare (UE) 2023/2447 prevăd, în plus, că măsurile care trebuie aplicate în respectivele zone de protecţie, zone de supraveghere şi zone suplimentare de restricţii, în conformitate cu regulamentul delegat respectiv, trebuie menţinute cel puţin până la datele stabilite în anexa la decizia de punere în aplicare menţionată.
(5)Anexa la Decizia de punere în aplicare (UE) 2023/2447 a fost modificată recent prin Decizia de punere în aplicare (UE) 2025/2635 a Comisiei (4), ca urmare a apariţiei unor focare de HPAI în Franţa, Germania, Italia, Ţările de Jos, Polonia şi Portugalia în unităţi în care erau deţinute păsări de curte, care necesitau să fie reflectate în anexa respectivă.
(4)Decizia de punere în aplicare (UE) 2025/2635 a Comisiei din 18 decembrie 2025 de modificare a anexei la Decizia de punere în aplicare (UE) 2023/2447 privind măsuri de protecţie vizând focarele epidemice de gripă aviară înalt patogenă din anumite state membre (JO L, 2025/2635, 23.12.2025, ELI: http://data.europa.eu/eli/dec_impl/2025/2635/oj).
(6)De la data adoptării Deciziei de punere în aplicare (UE) 2025/2635, Danemarca, Franţa, Germania, Italia, Polonia şi Portugalia au notificat Comisiei apariţia de noi focare de HPAI în statele membre respective în exploataţii de păsări de curte. Mai concret, notificările vizau un focar din regiunea Jutland de Nord din Danemarca, cinci focare din departamentele Calvados, Finistere, Deux-Sevres şi Vendée din Franşa, cinci focare din landurile Brandenburg, Mecklenburg-Pomerania de Vest, Saxonia Inferioară, Renania de Nord-Westfalia, Saxonia şi Saxonia-Anhalt din Germania, şase focare din regiunile Lombardia şi Veneto din Italia, două focare din voievodatele Mazowieckie şi Varmia-Mazuria din Polonia şi un focar din districtul Santarém din Portugalia.
(7)Ca urmare a celor 20 de focare noi, Danemarca, Franţa, Germania, Italia, Polonia şi Portugalia au luat măsurile necesare vizând menţinerea sub control a bolii în conformitate cu Regulamentul delegat (UE) 2020/687, inclusiv stabilirea unor zone de protecţie şi de supraveghere în jurul focarelor.
(8)În plus, focarul de HPAI apărut la păsări de curte în landul Renania de Nord-Westfalia din Germania este situat în imediata apropiere a frontierei cu Ţările de Jos. Întrucât zona de supraveghere pentru focarul menţionat din Germania se întinde şi pe teritoriul Ţărilor de Jos, autoritatea competentă din Germania a colaborat în mod corespunzător cu autoritatea competentă din Ţările de Jos pentru a stabili zona de supraveghere necesară, în conformitate cu Regulamentul delegat (UE) 2020/687.
(9)Comisia a examinat măsurile de control al bolii luate de Danemarca, Franţa, Germania, Italia, Ţările de Jos, Polonia şi Portugalia şi admite faptul că limitele zonelor de protecţie şi de supraveghere stabilite de Danemarca, Franţa, Germania, Italia, Polonia şi Portugalia şi limitele zonei de supraveghere stabilite de Ţările de Jos se află la o distanţă suficient de mare de unităţile în care au fost confirmate focarele de HPAI.
(10)Pentru a se preveni orice perturbări inutile ale comerţului din Uniune şi pentru a se evita impunerea de către ţări terţe a unor bariere nejustificate în calea comerţului, este necesar să se stabilească rapid la nivelul Uniunii, în colaborare cu Danemarca, Franţa, Germania, Italia, Ţările de Jos, Polonia şi Portugalia, zonele de protecţie şi de supraveghere stabilite de Danemarca, Franţa, Germania, Italia, Polonia şi Portugalia şi zona de supraveghere stabilită de Ţările de Jos, în conformitate cu Regulamentul delegat (UE) 2020/687.
(11)Prin urmare, este necesar să fie modificate arealele menţionate ca zone de protecţie şi de supraveghere pentru Danemarca, Franţa, Germania, Italia, Polonia şi Portugalia şi arealele menţionate ca zone de supraveghere pentru Ţările de Jos în anexa la Decizia de punere în aplicare (UE) 2023/2447, pentru a se ţine seama de limitele zonelor de protecţie şi de supraveghere stabilite de statele membre respective ca urmare a apariţiei noilor focare de HPAI în Danemarca, Franţa, Germania, Italia, Polonia şi Portugalia, precum şi durata necesară a măsurilor care trebuie aplicate în zonele respective, în conformitate cu Regulamentul delegat (UE) 2020/687.
(12)Prin urmare, anexa la Decizia de punere în aplicare (UE) 2023/2447 trebuie modificată în consecinţă.
(13)Având în vedere caracterul urgent al situaţiei epidemiologice din Uniune în ceea ce priveşte răspândirea HPAI, este important ca modificările aduse Deciziei de punere în aplicare (UE) 2023/2447 prin prezenta decizie să devină aplicabile cât mai curând posibil.
(14)Măsurile prevăzute în prezenta decizie sunt conforme cu avizul Comitetului permanent pentru plante, animale, produse alimentare şi hrană pentru animale,
