Art. 55
1.Without prejudice to the provisions giving effect to Articles 53 and 54 as contained in Protocol 21 and Annex XrV of this Agreement, the EC Commission and the EFTA Surveillance Authority provided for in Article 108(1) shall ensure the application of the principles laid down in Articles 53 and 54.
The competent surveillance authority, as provided for in Article 56, shall investigate cases of suspected infringement of these principles, on its own iniţiative, or on application by a State within the respective territory or by the other surveillance authority. The competent surveillance authority shall carry out these investigations in cooperation with the competent naţional authorities in the respective territory and in cooperation with the other surveillance authority, which shall give it its assistance in accordance with its internai rules.
If it finds that there has been an infringement, it shall propose appropriate measures to bring it to an end.
2.If the infringement is not brought to an end, the competent surveillance authority shall record such infringement of the principles in a reasoned decision.
The competent surveillance authority may publish its decision and authorize States within the respective territory to take the measures, the conditions and details of which it shall determine, needed to remedy the situation. It may also request the other surveillance authority to authorize States within the respective territory to take such measures.
