Psychological violence exerted on the employee to resign. Reconsidering the resignation

Violence alters the volitive nature of the freedom of consent, namely the person is aware of concluding an unfavorable act, but this is done to avoid a serious and imminent danger.

The mere threat of a possible disciplinary investigation cannot be vice of consent, but the circumstances in which it occurred and all the factual circumstances lead to the conclusion that the employee’s manifestation of own will for employment termination by resignation was not freely expressed, the employee’s consent being vitiated through moral violence.
