ABSTRACT

The sale of an inheritance is a theme that returns, by chance or not, to the forefront of theorists, but, especially, of legal practitioners. Of French inspiration, the sale of an inheritance was also regulated by the Old Romanian Civil Code, quite succinctly (through art. 1399-1401), and the current Civil Code devotes to this type of sale a relatively small number of items (art. 1747-1754) also. At the level of comparative law, apart from the French legal system that devotes the sale of an inheritance art. 1696-1698 of the French Civil Code, we have found the same type of sale only in the Italian Civil Code, art. 1542-1547, and in the Civil Code of Quebec, Canada, which devotes the sale of inheritance art. 1779-1781 of the Civil Code of Quebec.
