ABSTRACT

The sale of property of another is expressly regulated by the current Civil Code by Article 1683, as a variety of sale considered, in principle, valid in a certain legal regime specified by the legislator. The topic of "the sale of property of another" is analyzed for the first time by the current Civil Code. The old Civil Code, without expressly regulating this type of sale according to the model of Article 1599 of French Civil Code, through the related doctrine and jurisprudence, adopted on the basis of the general principles of law evidently derived from this Code, has constituted a source of inspiration for the theoreticians and practitioners of the law, the respective theme being extensively analyzed and the solutions adopted in the period prior to the current regulation were very similar to the solutions presently proposed.
