ABSTRACT
"Ut res magis valeat quam pereat" - that the matter may rather have effect than perish - but how far can this principle be extended before it strains its purpose? This is the central question when parties have designated a specific arbitral institution to administer their arbitration and that institution subsequently ceases to exist. In such circumstances, it falls to the tribunal or court to determine whether the arbitration agreement remains valid and enforceable. Accordingly, this article examines the effect of the dissolution of an arbitral institution on the validity and enforceability of arbitration agreements.
