ABSTRACT

This study examines the issue of the burden of proof in minor offence proceedings under Romanian administrative law. The research identifies the central subject as the interplay between the presumption of innocence afforded to the sanctioned individual and the relative presumption of lawfulness and validity attached to the minutes of ascertaining a contravention, especially when the offence is directly perceived by the reporting agent.
