ABSTRACT

The article analyzes the regime of functional protection of local elected officials in French law, from a comparative perspective with the Romanian legislative framework. The study highlights the legal mechanisms through which the public administration guarantees the defense of the dignity and independence of the mandate of the local elected official, in the face of attacks or pressures related to the exercise of the office. Through an approach based on legislative, doctrinal and jurisprudential analysis, the paper highlights the main convergences and differences between the two systems and formulates directions for improving the Romanian normative framework.
