Abstract

As it is about a land that was part of the railway infrastructure, being of general use and interest, declared by royal decree as being of public utility, which did not come out of the possession of the state, it disposing of the property through a concession in favor of the National Railway Company, the state's title is preferable to that of the former H, joint-stock company, from which the plaintiff acquired the property.

As public property of the state is inalienable, imprescriptible, the plaintiff's action in its entirety cannot be admitted, given that the state's title to the disputed land is preferable.
