ABSTRACT

The paper makes theoretical observations on the challenge of international commercial arbitration awards. By examining some concepts of arbitration and case law examples, it analyses common theoretical principles and premises underlying the laws and practice on the setting aside of arbitral awards. In this context, the paper addresses the concept of international public policy and concludes that, in the dimension of international arbitration, it is indeed salutary to apply an international or supranational concept of public policy.
