ABSTRACT
This paper deals with the question whether recognition and enforcement may be refused under Art. V of the New York Convention when an arbitral tribunal erroneously assesses an (alleged) choice of substantive law made by the parties. It will demonstrate that such errors qualify as an excess of mandate (Art. V(1)(c) NYC). However, the national courts' scope of review is limited to cases in which they obviously or evidently disregard or misinterpret such choice of law-agreement.
