Abstract

Article 15 of the Directive 94/62/EC of the European Parliament and of the Council of 20 December 1994 on packaging and packaging waste and the principle referred to as the “polluter pays" that it puts into practice are not contrary to the national regulations, which impose the contribution of an economic agent that does not intervene on the packaging entered on the market, calculated depending on the weight discrepancy between, on the one hand, the packaging waste quantity corresponding to the minimum energy recovery goals and the recycling recover and, on the other hand, the quantity of waste actually recovered and recycled.
