The article examines the conditions and effects of the suspension of the individual employment contract (CIM) during the strike, in light of Decision no. 5/2025 of the High Court of Cassation and Justice. The analysis highlights the essential distinction between joining the strike and effective participation - the only one that can determine the suspension of the CIM under art. 51 para.
