This study is subject to the analysis of the Decision of the High Court of Cassation and Justice No 16/2023 - the Panel for the resolution of the appeal in the interest of the law, in the matter of the contravenţional complaint. The authors offer a critical, different perspective on it, analyzing and combating the arguments offered by the Supreme Court that led to the admission of the appeal in the interest of the law.
