Establishing the Perpetrator's Degree of Discernment, a Decisive Element in the Training of Criminal Liability

Abstract

The paper presents and analyzes the criminal cases from the practice of Romanian courts in which acquittal solutions were ordered for the existence of non-imputability cases, as well as convictions with retention of some legal or judicial mitigating circumstances.

The lack of discernment operates only in the case of minors under the age of 14. Except for this case, the lack of discernment must be proven through a medico-legal psychiatric expert report in the situation of:...
