Salary weighting for harmful conditions due to the teaching staff in secondary education system

Abstract

In the circumstances under which no regulation has been adopted so far which should set forth the concrete amount of the salary weighting, the conditions of granting it, and the subsequent regulations regarding the remuneration [Order no. 47/2011, Law no. 63/2011, art. 9 para. (3)] provide for the maintenance for payment of the salary weighting for harmful or dangerous conditions in case of the persons who benefited from this salary weighting, whose activity is carried on under the same conditions, the court considers that the plaintiff is entitled to receive the salary weighting amounting to 15% for harmful or dangerous conditions starting from 1 May 2011 and until 31 August 2012, and the right of action for the previous period for which it was requested, has been time-barred.
