Brief considerations on the legal capacity of natural persons in employment relationships

Abstract

The legal capacity of natural persons in employment relationships has a number of particularities compared to common law (civil law), which arise from the need for social protection of the employee as a vulnerable party to the employment relationship. A special situation is that of the minor employee, as well as that of the minor with anticipated full capacity to work who is theoretically entitled to become an employer. It is also necessary to analyse the level of protection and the nature of the protection enjoyed by the minor employee during the non-contentious stage of the employment relationship, compared to the degree, nature, and purpose of the protection during the contentious stage of this relationship.
