Abstract

The aim of this article is to analyse Article 374 paragraph 1¹ of the Romanian Criminal Code. Firstly, the author presents several definitions of "child pornography" and then argues that that the variant of child pornography under Article 374 paragraph 1¹ must be treated as a special type of trafficking underage victims. Likewise, the author analyses whether the offence of child pornography can be considered to be a special type of exploitation of vulnerable persons.
