ABSTRACT

The study tends to analyze the institution of unpredictability in correlation with the principle of the binding force of the contract, the freedom of will of the parties and in association with the economic, social, financial determining factors, including the dynamism of the law, which, through validation, brings them into the field imposed by the common good.

The objective, extraordinary, exceptional and unpredictable character, as existence and extent of the disruptive factor, is analyzed in the study in association with the impact on the contract, on the balance of services, from the perspective of the relationship from effect to cause, since its mere existence remains irrelevant in the absence of this relationship.
