Revisiting the Procedural act. II. Categories of legal claims

Abstract

Claims and applications submitted to the courts hold significant importance, as they initiate judicial proceedings, define the procedural framework, and shape the course of litigation.

Romanian legal doctrine typically provides classifications or enumerations of some types of claims and applications that may be addressed to the courts.

Nonetheless, there exist additional forms of claims or modalities of structuring them that are either seldom mentioned or entirely overlooked in the literature. This paper seeks to contribute by offering a more systematic analysis and by supplementing the theoretical understanding of this procedural category.
