ABSTRACT

In this study, the author aims to answer a question often encountered in judicial practice, namely whether the schedule of personal relations between the minor and the non-resident parent or other person can be restricted for the protection of the private life of the resident parent.

In this approach, it starts from the presentation of the notions of "family life" and "private life" and a definition of the "right to personal relationships" is proposed.

The exposure of a situation from judicial practice on two levels of analysis is likely to reflect the author’s argued conclusion, namely that the restriction brought to the private life of the parent with whom the child lives does not constitute a reason for limiting the minor’s right to be visited by the other...
