ABSTRACT

An imperfect legislative change may bring more problems than those are existing in present and also than those which are envisaged by the legislator. Thus, a modification in the matter of collective bargaining at the beginning of 2016 amplified the problems in Social Dialogue Law and added new ones. The possible effects of this modification are the decrease of the number of collective labor contracts, the affectation of the right of employees to be represented in collective bargaining and even the suppression of this right. To these problems may be added the existing premise to trigger some potential procedures to contest the registration of collective labor contracts.
