Abstract

From 2022 onwards, a major change is coming to the forefront of the civil capacity of people with disabilities. Thus, the institution of judicial prohibition is eliminated and replaced by two new measures, differentiated according to the degree of deterioration of mental faculties, namely judicial counselling, a measure that preserves a restricted capacity of exercise of the protected person, and special guardianship, able to meet the needs of the person without capacity of exercise.
