Abstract

Following a brief presentation of the role and functions of judicial councils in the world and considering that over the last few years the Superior Council of Magistracy, declared as “the gurantor of the independence of the Romanian judicial system", has become subject of controversies, this paperargues in favour of a deep change of this institution with regard to its composition and internal organisation an functioning. Not the least, the reform of the Romanian judicial council should aim at a moral reform of its members which, in its turn, could contribute to enhance a real and effective independence of the Romanian judiciary.
