ABSTRACT

This study containes a theoretical and practical commentary of the article 90 from the Romanian Constitution. The author analyses the following themes: conceptual delimitations regarding the notion of referendum and plebiciste; the referendum as a way of practicing of the people sovereign will; the conception of the Constituent Assembly regarding the referendum; the features of the referendum provided in article 90 of the Constitution; constitutional and legal procedure of the referendum; the consequences of the referendum in the Romanian constitutional system.
