ABSTRACT

The author comments upon the article 106 from the Romanian Constitution, revised in 2003. The article 106 regulates the conditions of case upon of the Government membership. These are the resignation, dismissal, disenfranchisement, incompatibility, death or any other cases provided by law. In his commentary, the author analyses the notion of the Government membership and categories of membership, the beginning and the ending of the Government membership, and the reason of ceasing to the office of the Government members.
