Abstract

In this article, the author analyzed the institution of international recidivism, the situation in which the first conviction is handed down by foreign courts. Given the free movement of people within the borders of the European Union, criminality migration has inevitably occurred. For this reason, the research was focused on European legislation regarding the recognition of convictions and how it was interpreted in the case-law of the Court of Justice of the European Union, in order to identify how European law influenced the application of national law.
