ABSTRACT

The criminal liability in labour law certifies the importance granted by the authorities to workers protection, not only by establishing very elaborate labour law provisions, but also by penalising those employers which do not observe the employees rights.

In order to draw clear boundaries between a minor offence and a more serious breach of law in the employers conduct, it is required a very good knowledge of the specific labour laws provisions, but also of the employers actions which, though seemingly legal, in reality, are not in accordance with the law’s provisions and its vision.

The following article will be presenting the most common cases concerning the ways the employers use to elude the legal provisions and to avoid enforcing sentences through which the employees won their non - payed wages or the right to return to the jobs they had formely and unlawfully been dismissed.
