ABSTRACT

Freedom of association is considered a human right, and the law should prevent any discrimination of employees based on union membership and activity in relation to employment, distribution of work, vocational training, career advancement, salaries and social benefits, disciplinary measures, and dismissal. The prohibition to dismiss the leaders of trade unions is objective in nature, in that the connection between the quality of elected representative in the management bodies of the union and the dismissal ordered by the employer for constraint purposes needs not be proven, as it is presumed by the legislature in order to protect and ensure the freedom of association.
