Abstract
Decision no. 302 of march 2011reveals one major problem encountered in theory, but especially in practice at the border from the free access to the information of public interest and its corollary, the limitation of this fundamental right by the public authorities, through the classification of some public information. Regulated by many laws, which are not always harmonized, the process of classification may become a threaten for the rights of the citizens but also for the separation of powers in the state, because the judge does not always have access to the internal reasons why the public...
