ABSTRACT

The present article aims to highlight two issues specific to judicial management expertise, i.e. the characteristics of the objectives to the expert’s report and the specifics of the trial procedure.

The article starts with the concept of “management judicial expertise" and the role of the court-appointed expert.

It then analyzes the characteristics that the objectives of the expert’s report must meet in relation to the specifics of the proceedings.

Next, the specific features of the trial procedure are analyzed, i.e. the incidence of the adversarial principle, the time and manner of appointing experts and the issue of the reimbursement of the expert’s fee if the application for the expert’s report approved in the first instance is invalidated in the appeal.
