Abstract

The concept of traffic accident is defined by the disposition art. 75 of O.U.G. no. 195/2002.

In order to consider that the event resulted in the death of the victim constituted a traffic accident, it is essential to establish the nature of the road on which it occurred, respectively if this is a road open to public circulation, which falls within the regulatory field of O.U.G. no. 195/2002, only in this hypothesis the violation of the positive and negative obligations established by the provisions of art. 76-79 of the same normative act being able to be considered in the responsability of the involved persons.
