The trustee's duty to account. Statutory compensation and limitation period invoked on appeal

Abstract

In the present case, the court examines the legal effects of non-performance of contractual obligations, on the one hand, the termination of a promise of sale and the return of a sum of money under the criminal clause, and, on the other hand, the performance in kind of the obligations arising from a mandate contract in respect of both the trustee and the principal. Also, in this context, the court applies the provisions relating to statutory compensation as opposed to the extinctive limitation period first invoked on appeal.
