O modificare nefericită a Legii dialogului social nr. 62/2011

ABSTRACT

Social dialogue Law nr. 62/2011 has undergone several changes through Law no. 1/2016. Some of these amendments concern the representation of employers and employees from collective bargaining.

But the legislature has amended art. 134, without noticing that he have modified also art. 135 beeing in correlation. As a consequence there are discrepancies between the two texts what hampers their application and thus impedes collective bargaining.

REZUMAT

Legea dialogului social nr. 62/2011 a suferit mai multe modificări prin Legea nr. 1/2016. Unele din aceste modificări privesc reprezentarea angajatorilor şi angajaţilor la negocierea colectivă.

Dar, legiuitorul a modificat art. 134, fără să observe că trebuie modificat şi art. 135, aflate în corelare. Ca o consecinţă există neconcordanţe...
