ABSTRACT

The article deals with an actual Romanian jurisprudential controversy: the formal conditions regarding the endorsement signatures on bills of exchanges and promissory notes. Some courts find that this signature must be readable to ensure the identification of the signatory and without this formal requirement fulfilled they consider that the approval of enforcement of such a bill against the endorser is not possible. Other courts in contrary consider that the simple, usual signature of the endorser is adequate and they see the enforcement possible.
