ABSTRACT

The recent changes brought to the Criminal Code by Law no. 217/2023 and Law no. 424/2023 represents a significant step in clarifying the regulations on the crimes of rape, sexual assault and the protection of victims, especially minors. The new rules aim to align Romanian legislation with international standards and eliminate gaps that have allowed contradictory interpretations in practice. Key changes include setting the minimum age of consent at 16, extending the statute of limitations for rape on minors, clarifying aggravating circumstances, and introducing new related crimes, such as facilitating sexual acts between minors.
