ABSTRACT

Criminal law underwent a major reform in 2014 with the entry into force of new codes. Although it constitutes one of the most reformist legislations in criminal matters, the effects after 10 years of application are not among the most encouraging: there are currents of opinion that determine the return to the philosophy of the previous codes and the criminal policy until 2014, the narrowing of the sphere of individualization of the sanction and the use of general prevention to mask the inefficiency of the discovery and prosecution of persons who have committed crimes, as well as the transformation of the criminal process into a long delay waiting for the prescription of criminal liability.
