ABSTRACT

The Labor Code contains several provisions that establish it as the common law in the field of employment legal relationships.

It applies not only to relationships arising from individual employment contracts - covering employees and their employers - but also to other employment relationships that are not based on such contracts, deriving instead from special regulations.

Thus, the application of the Labor Code extends in certain areas to other categories of employees/workers (such as public servants, including those with special status, military personnel, magistrates etc.) as well as to employers, including public authorities and institutions.

This article specifically examines the amendments to the Labor Code introduced by Law No. 283/2024, presented and explained in an original manner.
