Abstract
The right to the protection of personal data has only recently been acknowledged by the States. As of the 1stof December 2009, when the Lisbon Treaty, and consequentlyy, the Charter of Fundamental Rights of the European Union came into force, the right to the protection of personal data gained the status of a fundamental right (provided for by Article 8 of the Charter), as the activities falling within the scope of the European Law are concerned. As for the national legislation of the Member States of the European Union, the right to the protection of personal data right has so far been included in the Constitution of only a few States. Nevertheless, most Member States (including Romania) and the Council of Europe, as well, have placed great importance on the fundamental right to privacy where the right to the protection of personal data originates from.
