The moment from which legal penalty interest begins to accrue in cases of moral damages compensation

Abstract

This study aims to address a matter of paramount importance in judicial practice, namely the moment from which legal penalty interest is due in cases of patrimonial compensation for non-patrimonial damage. Traditionally controversial, this legal issue needs to be analyzed from the perspective of the novel provisions contained in the 2009 Civil Code. This concerns, on one hand, the provisions regarding the means of defending non-patrimonial rights [Article 253 paragraphs (1)-(4) Civil Code], as well as those regulating the conditions required for the assignment of compensation claims [Article 1391 paragraph (3) Civil Code]....
