ABSTRACT

By law, unions are set up to protect the professional, economic and social rights of the employees, as stated by the Code of Labor, by other legal acts, by the collective and individual employment contracts, etc.

According to their duties and attributions, trade unions defend their members, as a rule, against the employer or against some of the employer’s measures. Never conversely! It would be illogical, irrational, unlawful.

Yet, there is a case în which exactly the opposite happened: the union intervened în a law suit to “defend" the employer against the fired employee.

REZUMAT

Potrivit legii, sindicatele se constituie în scopul apărării drepturilor şi intereselor profesionale, economice şi sociale ale salariaţilor, prevăzute în Codul muncii, alte acte normative, în contractele colective şi individuale de muncă etc.
