ABSTRACT

This article contains two important sections. The first refers to the Judgment of the Court of Justice of the European Union dated April 3, 2025, delivered in Case C-431/23, WIBRA BELGIE SA, which concerns the interpretation of Article 5(1) of Council Directive 2001/23/EC of March 12, 2001 on the approximation of the laws of the Member States relating to the safeguarding of employees’ rights in the event of transfers of undertakings, businesses or parts of undertakings or businesses.

The second part addresses the protection of employees’ rights in the event of a transfer of an undertaking, a business unit, or parts thereof, under national law, specifically the relevant provisions of the Labour Code and related legislation.
