Abstract

Bribery is an instantaneous offense that is consumed when the official has received, claimed, accepted or refused to remit money or other undue benefits, in order to fulfill, to not perform or to delay the performance of an act that he was bound by his duties or performed an act contrary to these duties.

Judicial practice has consistently confirmed this view by repeatedly stating that, as long as the bribery offense is consumed at the time when officials receive the promise of money or other benefits for the purposes outlined above, it’s irrelevant that the money or the promised benefits were given after the act.
