ABSTRACT

The start of a forced execution in which the debtor's patrimonial asset is liquidated is the premise for the activation of the privileges, perceived as tools for ordering the creditors when the "price of the debtor's assets" is divided [art 2326 para. (1) Civil Code].

A privileged creditor is preferred to the other creditors, even if their rights were born or registered earlier (art 2335 Civil Code).
