Abstract

The European Arrest Warrant. Enforcement. Formal and substantive conditions.

Circumstances raised by the person sought in that he/she is not the perpetrator of acts mentioned in the arrest warrant, that the condition of his health is poor and has a dependent child aged 2, does not fall within the grounds which may lead to refusal of the execution of the European Arrest Warrant as provided for by the provisions of Article 88 of Law No. 302/2004.

Împrejurările invocate de către persoana solicitată în sensul că nu este autorul faptelor indicate în mandatul de arestare, că starea sănătăţii sale este precară şi că are în întreţinere un copil în vârstă de 2 ani nu se încadrează între motivele care pot conduce la refuzarea executării mandatului european de arestare aşa cum prevăd dispoziţiile art. 88 din Legea nr. 302/2004.
