Abstract

The institution of the comminatory fine comes within the enforcement stage of the civil trial and is specific to the direct enforcement of a judgment concerning the performance of the obligations to do intuitu personae, other than those provided by art. 575 of the Code of Civil Procedure, referring to the delivery of the movables by a writ of execution or art. 578 of the Code of Civil Procedure, regarding the delivery of the immovables by a writ of execution.

Rezumat

Instituţia amenzilor cominatorii se circumscrie însă fazei execuţionale a procesului civil şi este proprie executării silite directe a obligaţiilor de a face intuitu personae, altele decât cele prevăzute în art. 575 C. pr. civ., referitoare la predarea silită a bunurilor mobile ori art. 578 C. pr. civ., referitoare la predarea silită a bunurilor imobile.
