Abstract

The recently enacted New Civil Code regulates, for the first time, two fundamental constitutional liberties: freedom of speech and the right to privacy. This paper is focusing on the normative structure of the New Civil Code regarding these two novel legal institutions, starting with an introduction based on the famous Harvard Law Review article "The Right to Privacy" from 1890, co-authored by Samuel Warren and Louis Brandeis, and further examining the main features, the constitutional links and the predictable legal challenges that freedom of speech and privacy will put before the Romanian courts in establishing a long lasting and valuable case law in this field.
