ABSTRACT

This article analyzes the case law of the Court of Justice of the European Union (CJEU) on the access of third countries to the EU public procurement system, with a focus on the specific implications for Romania. The article highlights Regulation (EU) no. 2022/1031, which aims to improve conditions for EU companies competing for public contracts abroad, while stipulating reciprocal access for non-EU entities. The article looks at recent CJEU decisions, in particular the Kolincase (C-652/22), which clarifies the legal regime applicable to third-country economic operators participating in public procurement procedures in the EU.
