In Romania and the Republic of Moldova, we believe that the institution of mandatory mediation in disputes between professionals, especially between those with small and medium-sized businesses, could have a chance of success, after recently, on September 3, 2024, in case C-658 -23, the Court of Justice of the European Union established that if the Constitutional Court of Romania invalidated a law that stipulates as mandatory the information session regarding the mediation fees, then the court can not to apply the decision of the Constitutional Court.
