ABSTRACT

Interpretation of law and contract, which structures the study, aims to distinguish between the two forms of interpretation, but at the same time the approach tends to frame them in their unity in the process of law making. The generality, rigor and detail of regulation is correlated with the broad or narrow limits of interpretation, with the dynamics of the social phenomenon that dictates and shapes interpretation, with the persistence and perishability of regulation. The integration of time in the rule, in its interpretative process, generates the temporal de-phasing of the law from the social phenomenon, and gives interpretation a social significance.
